The Declaration of Independence of The United States of America

人類の歴史のなかで、ある国民と他の国民を結びつけてきた政治的なつながりを解消し、世界の国々のなかで自然の法則と神の法則が与えてくれる、独立した対等な立場をとることが必要になる場合がある。
When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume, among the Powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them,

その際に人類のいろいろな意見にきちんとした敬意をはらうには、分離へと駆りたてられる原因を述べなければならないだろう。
a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

われわれは、以下の事実を自明のことと考えている。
We hold these truths to be self-evident,

つまりすべての人は生まれながらにして平等であり、すべての人は神より侵されざるべき権利を与えられている、その権利には、生命、自由、そして幸福の追求が含まれている。
that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness.

その権利を保障するものとして、政府が国民のあいだに打ち立てられ、統治されるものの同意がその正当な力の根源となる。
That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,

そしていかなる政府といえどもその目的に反するときには、その政府を変更したり、廃したりして、新しい政府を打ちたてる国民としての権利をもつ。
That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it,  and to institute new Government,

新しい政府は、国民の安全と幸福が最大となるような原則の基盤の上に打ちたてられ、また国民の安全と幸福が最大となるような形の権力の組織化を図らなければならない。
laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

実際には分別を働かせれば、長いあいだ確立されてきた政府は、軽々しい一時的な理由で取って代わられるべきではないということはわかるだろう。
Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes;

従って今までの経験では、人類は不満がある政府を廃止して誤りを正すよりは、その弊害が耐えられる限りは耐える傾向にあるのだ。
and accordingly all experience hath shown, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.

しかし権力の乱用や強奪が長くつづき、絶対専制支配の下に置こうとする意図が明らかで、その同じ目的をずっと追求しようとしているときには、そんな政府をなげすて、自分たちの将来の安全を新たに防護してくれる政府を求めるのが義務である。
But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

これこそが、この植民地が耐えしのんできたことである。
--Such has been the patient sufferance of these Colonies;

そしてこのような必要性に迫られて、現在の政府を変えなければならなくなったのだ。
and such is now the necessity which constrains them to alter their former Systems of Government.

現在の英国国王による歴史は、傷つけ、奪ってきたことの繰り返しであり、その直接の目的は、これらの州への絶対専制を打ちたてることである。
The history of the present King of Great Britain is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States.

これを証明するために、偏見のない世界へ事実を知らせたい。
To prove this, let Facts be submitted to a candid world.

国王は、もっとも健全かつ公共の福祉に必要な法律に異議をとなえてきた。
He has refused his Assent to Laws, the most wholesome and necessary for the public good.

国王は、自分が承認するまでその執行をさしとめなければ、緊急かつ差し迫った重要性をもつ法律を植民地の総督が通過するのを禁じた。
He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained;

さしとめておいて、法律に注意をはらわず完全に無視してきたのである。
and when so suspended, he has utterly neglected to attend to them.

国王は、国民が立法府における代議権を放棄しなければ、その国民の広大な地域を調整する法律を通すことも拒否してきた。
He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature,

その権利は国民にとっては大事なものであり、専制君主のみにとって問題となるものである。
a right inestimable to them and formidable to tyrants only.

国王は、国民が根負けし、自分の政策を守るようにする目的だけのために、いつもとは違った不便で公文書の保管場所からも離れたところで立法府を召集した。
He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their Public Records, for the sole purpose of fatiguing them into compliance with his measures.

国王は、国民の権利を侵害するのに断固として反対したという理由で、下院を何回も解散してきた。
He has dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

国王は、解散の後で、立法府を廃止することはできないので、その行使を一般の人々に戻すことによって、選挙を行うことを長い間拒否してきた。
He has refused for a long time, after such dissolutions, to cause others to be elected; whereby the Legislative Powers, incapable of Annihilation, have returned to the People at large for their exercise;

合衆国はそのあいだ、外国の侵攻や国内の動乱の危険にさらされてきた。
the State remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

国王は、合衆国の人口の増加をなんとか押さえようとしてきた。
He has endeavoured to prevent the population of these States;

そのために外国人の帰化の法律に反対し、
for that purpose obstructing the Laws of Naturalization of Foreigners;

合衆国への移民を奨励する法律が通過することを拒否し、新たに土地を取得する条件を厳しくした。
refusing to pass others to encourage their migration hither, and raising the conditions of new Appropriations of Lands.

国王は、司法権を確立する法律へ異議をとなえることで、司法の執行を妨害してきた。
He has obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary Powers.

国王は、在職期間や給与の額や支払方法で、司法を自分の意のままになるようにしてきた。
He has made judges dependent on his Will alone, for the tenure of their offices, and the amount and payment of their salaries.

国王は、多くの官職を設け、多くの役人をわれわれ国民をこまらせるために派遣してきており、その財産を食いつぶしている。
He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our People, and eat out their substance.

国王は、平時でさえ、立法府の同意なしにわれわれのところに軍隊を駐留させている。
He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures.

国王は、軍隊に文民統制から独立し、優越した力を与えるようにしてきた。
He has affected to render the Military independent of and superior to the Civil Power.

国王は共謀して、憲法が及ばない、法律によっても認められないような司法権にわれわれを従わせるようにしてきた。
He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws;

そしてうわべだけの立法行為による、次のような法律に承諾を与えたのだ。
giving his Assent to their Acts of pretended legislation:

大規模な軍隊がわれわれのところに駐留する法律州の住民に対して犯した殺人の罪から、模擬裁判で軍隊を保護する法律
For quartering large bodies of armed troops among us:
For protecting them, by a mock Trial, from Punishment for any Murders which they should commit on the Inhabitants of these States:

世界中とのすべての地域との貿易を遮断する法律
For cutting off our Trade with all parts of the world:

われわれの同意なしに課税をする法律
For imposing taxes on us without our Consent:

われわれから多くの事件において、陪審による裁判をうける利益を奪う法律
For depriving us, in many cases, of the benefits of Trial by Jury:

みせかけの罪で裁判にかけるために、海を越えてわれわれを移動させる法律
For transporting us beyond Seas to be tried for pretended offences:

アメリカに隣接した地域でイギリスの法律が自由に執行されるのを廃し、そこに独裁的な政府を樹立し、その政府がこのアメリカの植民地にも同じような独裁制を導入しようとする例に、また格好の手段となるように、国境を拡大しようとする法律
For abolishing the free System of English Laws in a neighbouring Province, establishing therein an Arbitrary government, and enlarging its Boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule into these Colonies:

われわれの憲章を奪い、もっとも大事な法律を廃止し、根本から政府の形をかえる法律
For taking away our Charters, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments:

われわれアメリカの立法府の活動を一時停止させ、みずからが今後すべてのケースにおいて立法権をもつとした法律
For suspending our own Legislatures, and declaring themselves invested with Power to legislate for us in all cases whatsoever.

国王はアメリカが保護対象外だと宣言し、宣戦布告することでアメリカの統治を放棄した。
He has abdicated Government here, by declaring us out of his Protection and waging War against us.

国王はアメリカの海を略奪し、沿岸地域を荒し、町を焼き払い、多くのわれわれアメリカ国民を殺した。
He has plundered our seas, ravaged our Coasts, burnt our towns, and destroyed the lives of our people.

国王は、現在大規模な外人傭兵部隊を派遣し、死と破壊と暴政を全うしている。
He is at this time transporting large armies of foreign mercenaries to compleat the works of death,

それらは、野蛮な時代の残虐さや裏切りにも匹敵するほどの状況の中で始まっていて、十分に文明化した国の指導者としてはふさわしくないことである。
desolation and tyranny, already begun with circumstances of Cruelty & perfidy scarcely paralleled in the most barbarous ages, and totally unworthy of the Head of a civilized nation.

国王は、公海上で捕虜にしたアメリカ市民たちに武器をとって、アメリカと戦い友人や同朋の死刑執行人になるのか、自分で自分の命を絶つのかを強制してきた。
He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands.

国王はアメリカで内乱が起こるように扇動し、辺境の地に住む人々や残酷な野蛮人のインディアンを育成しようとしてきた。
He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers, the merciless Indian Savages,

彼らのよく知られた戦いの掟は、年齢や性別や状態に関わらず無差別に殺すというものである。
whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions.

このような圧制のあらゆる段階で、われわれはできる限り丁寧な言葉で、それらが取消されることを嘆願してきた。
In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: 

われわれがくりかえし嘆願してきたことは、ただくりかえし傷つけられることでしか報いられなかった。
Our repeated Petitions have been answered only by repeated injury. 

専制者であるかのような全ての行為により、その性格が特徴づけられる国王は、自由な人々の統治者としてはふさわしくない。
A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free People.

われわれは同胞のイギリス国民が注意をはらってくれることを望んでいるだけではなく、
Nor have We been wanting in attention to our British brethren.

イギリスの立法府がわれわれに不当な司法権をかざそうとするのを折にふれ警告してきた。
We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us.

われわれは、イギリス国民にわれわれが移民して、ここに移住した状況を思い起こさせてきた。
We have reminded them of the circumstances of our emigration and settlement here.

われわれは彼らの正義心、そして度量の大きさに訴えかけてきて、われわれの間のつながりや交流を断ち切ってしまうようなこれらの略奪行為をやめるように、血縁の結びつきをつかって思い起こさせてきた。
We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which would inevitably interrupt our connections and correspondence.

しかしイギリス国民もまた、正義と血縁関係にもとづく声に耳を傾けてはこなかった。
They too have been deaf to the voice of justice and of consanguinity.

だから、われわれは分離を宣言し、イギリス国民に対しても、世界の他の国々と同様に、戦時には敵に、平和時には味方になる必要性に従わざる得ない。
We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends.

だから、われわれはアメリカ合衆国を代表して、大陸会議を召集し、われわれの意図が間違ってないことを世界のすぐれた司法にアピールし、アメリカ植民地の善良な国民の名前と権威において、厳粛に次のことを出版し宣言する。
We, therefore, the Representatives of the United States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by the Authority of the good People of these Colonies, solemnly publish and declare,

アメリカ植民地は自由で独立した国家で、また権利として自由で独立した国家であるべきである。
That these United Colonies are, and of Right ought to be Free and Independent States;

アメリカ植民地は、イギリス国王に対するあらゆる忠誠の義務を免れる。
that they are Absolved from all Allegiance to the British Crown,

アメリカ植民地と英国との全ての政治的なつながりは完全に解消し、また解消されるべきである。
and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved;

そして自由で独立した国として、戦争をはじめ、平和を締結し、同盟をむすび、通商を開く全ての権利と、独立した国家が当然行う権利をもつ全ての物事を実施する権利をもつ。
and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do.

この宣言を支持するために、神の摂理による加護を強く信じて、われわれはお互いの生命と財産、そして名誉にかけて相互に誓いをたてる。
And for the support of this Declaration, with a firm reliance on the Protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.
